Tucson police board finds officer justified in shooting illegal alien

Tucson (AP) -- A Tucson police board of inquiry has found that an officer who fatally shot an illegal immigrant during a violent scuffle was justified in using deadly force.

Officer Douglas Dreher's actions in November when he shot a man who had attacked him with his own baton were found to be within department policy, according to a summary of the incident obtained by the Arizona Daily Star on Friday.

Dreher was driving his patrol car near Interstate 19 when he ran the license plate of a van driven by Francisco Javier Yanez-Burruel, 35, of Magdalena, Sonora.

Dreher found the vehicle's registration had a mandatory insurance suspension and pulled the van over. Soon after, both men in the van got out and ran away.

When Dreher caught up with Yanez, he refused to surrender, according to the summary of the incident. The two exchanged blows, and Dreher eventually got Yanez in a headlock.

That's when Dreher felt tugging at his duty belt and gun. Dreher secured the gun, but Yanez grabbed his baton and confronted him in a threatening matter, according to the summary.

When Yanez advanced, Dreher fired three times, hitting him in the chest and killing him.
