Attorney to appeal Lebanese man's immigration fraud conviction in US

Minneapolis (AP) -- The attorney for a Lebanese man arrested in a 2004 terrorism investigation says he will appeal his client's conviction on charges of possessing fraudulent immigration documents.

Paul Engh filed a notice of appeal on Monday on behalf of his client, Mohamad Kamal Elzahabi.

The 44-year-old Elzahabi was arrested in May 2004 and convicted by a federal jury last August. He was sentenced in March to the nearly four years he has already served and was released to U.S. Immigration and Customs Enforcement officials.

Court documents say he is currently in an ICE holding facility in El Paso, Texas.

During his sentencing hearing, Elzahabi told the court he had been charged just so he could be detained.

He never faced charges of terrorism. However, an FBI affidavit says he acknowledged that he had attended a jihad training camp, fought as a sniper in Afghanistan for al-Qaida in the early 1990s and had connections to high-ranking members of the terrorist organization.
