Man jailed for attempting to use fake Social Security card

FORT EDWARD -- A homeless illegal immigrant who tried to use a fake Social Security card to get public assistance benefits has been arrested and jailed, police said.

Pablo Martinez-Gutierres, 49, was charged Friday, after the Washington County Sheriff’s Office was contacted by the county Department of Social Services about possible fraud by someone applying for public assistance, officials said.

Martinez-Gutierres was with his wife at the social services office, and police determined that there was an order of protection against him barring him from having contact with her because of an assault charge filed against him in Virginia that accused Martinez-Gutierres of abusing his wife, police said.

A check with federal immigration officials found that Martinez-Gutierres had been arrested several times for being an illegal immigrant and deported each time, the Sheriff’s Office said. He had used fake names, dates of birth and social security numbers several times, officials said.

They did not name the country to which he was native.

Martinez-Gutierres was charged with second-degree criminal contempt, a misdemeanor, for allegedly violating the order of protection. The U.S. Department of Immigration and Naturalization Services has filed a detainer warrant against him for the apparent violations of immigration laws.

He is being held in Washington County Jail after arraignment in Kingsbury Town Court.

Sheriff’s Deputy Mike McWhorter made the arrest.
